I have been discharged from bankruptcy for 4 years. My mortgage was not reafirmed, however, I just walked away from the house 6 mos ago.

It is now going through the forclosure proceedures in order for the mortgage company to get title back in their name.

I am now being told i have to wait a period of time after forclosure for a new mortgage. I took my hit four years ago and they cannot report to my credit anymore.

Any idea?

I live in Ohio and after you are discharged from bankruptcy, the bankruptcy still stays on your credit report either for 7 or 10 years.

My understanding BUT I am not positive:

Since the lien survived your bk (passed through unaffected - remember the debt was discharged, not the lien) reporting a foreclosure of the lien on your credit report is allowed since it is not an attempt to collect or report the debt itself.

Again, I could be wrong on this but it does make sense, at least to me.

Filing Bankruptcy is a difficult decision to make. Bankruptcy can help you prevent foreclosure of your home, stop debt collector harassment and get a fresh financial start. Many people turn to a Link removed per tos for help. Bankruptcy Lawyers can help explain bankruptcy law and ensure that the bankruptcy process goes as smoothly as possible.

:cool::DIf you are facing the process of foreclosure or repossession then you need immediate assistance. You must be sued in order to be foreclosed upon. The process begins when you get papers from the clerk of courts. You may receive them several ways, and more than once. They come by, certified mail, delivery by the sheriff, and sometimes by a private individual hired to hand the papers to you. When you read them, you will see that you have 28 days to file an answer. The purpose of filing an answer is for you to dispute or disagree with the mortgage company's assertion that you are late in your payments. Typically, people do not file answers to foreclosures because most of the time they are behind in their payments. If you want to get more idea on that try to refer to the one i trusted in cincinnati bankruptcy attorney.:D:D:D
