Can any one tell me what hardship discharge in Chapter 13 bankruptcy is? When should one file it?


Chapter 13 bankruptcy hardship discharge may be granted by the court, even if you have failed to complete plan payments if circumstances under which you request are beyond your control and through no fault of your own!

The discharge will only be granted if the creditors have received at least as much as they would have received in a chapter 7 bankruptcy liquidation case and when modification of the plan is not possible.

Hardship discharges can be granted due to injury or illness that causes loss of employment making funding even a modified plan not possible. The hardship discharge is more limited than a regular chapter 13 discharge and does not apply to any debts that are non-dischargeable in a chapter 7 bankruptcy case.
