bankruptcy questions

My husband and I are in default on several credit cards.We have never filed bankruptcy,have a joint checking account and my husband has a garnishment on his check already for child support.We have changed our phone number but somehow one of the collection agencies found our new number and I answered the phone.When she told me she was calling about the debt i was shocked and did'nt know what to say.I told her we were filing bankruptcy and would be including that debt in the bankuptcy.She then asked me for the name of my attorney and I told her i did not have the name as we have not paid one, that we had only been speaking with attorneys.Did I mess up? We are about 6 months behind on the card I was called about.It is in my husband's nmame and I am listed as a user on it.We have other cards that are almost a year in default, some in both our names some that are seperate.If a collection agency digs into your info and sees you have never filed bankruptcy before and that your credit is already as bad as it can get would'nt they realize that is would be a waste of time to summon you to court when a person can file bankruptcy before the court date and stop it?


Thanks for the help.We are planning to file but we are so broke we can't afford to pay an attorney right now.It will be a while before we're able to come up with money so I was hoping to delay bankruptcy. We are including our home in the bankruptcy too so we are gonna have to find a new place to live and need time to save for that.I was just praying my credit card companies would hold off on sueing us until we have the money to file bankruptcy so we can stay in our home a bit longer.Since my husbands check is garnished, we are using prepaid debit cards and keeping a $2.00 balance on my checking account now and from here on hopefully they will see there is no way to get any more out of us and not sue.How likely is that?
