My husband has a debt of around $1,250,000. We got divorced few months back. Now the creditors are calling me repeatedly. They are asking me to pay off the debts. Am I liable to pay off the debt? If yes, then I have no option but to file bankruptcy. In that case, should I file bankruptcy alone or file jointly with my x-husband.


If you live in a community property state and the debt was incurred during the marriage, regardless of whose debt it was or what your divorce decree says you are liable.

If you do not live in a community property state and you were/are on the loan or the account you are liable.

If a creditor sues you and gets a judgment you are liable.

You cannot file a joint bankruptcy since you are divorced.

You need to meet with a qualified bk attny to explore your options.
