So, I am needing to file bankruptcy, but I have run into some problems. One of them is the fact that I live with my parents. Now, my name is not on the mortgage or cars (my parents each own a car), so I am not worried about any of that, but the means test is the one that I am worried about. Will I have to use my parents' income on the means test? They actually don't have any income coming in right now, as they both have been unemployed for most of 2009. I am the only person in the house that is working right now, but it is temporary, so I may be unemployed again pretty soon. So, again, will I have to use my parents' income (or lack thereof, unfortunately) or will I be able to use mine?
By the way, I am living rent-free but have had to buy my own personal care items and clothes, among other things. Needless to say, the only things my parents are providing for me is food and a place to stay.

Most likely you can file separately without including your paren
Most likely you can file separately without including your parents' income in the means test. However, the best way to learn about it is by asking a bankruptcy lawyer.
