Hello all-

I filed chapter 7 and have already had my hearing. Now I received a letter from a company called Purchasing Power. I did purchase two items from them. One was an IPOD and the other was a flat screen toshiba tv. For those of you that don't know, Purchasing Power is a firm that sells computers and other electronics, and then you pay through payroll deductions. You are usually paying a much higher price for the items - because of this. When I filed bankruptcy, I had paid about 60% of the IPOD and 50% of the TV. I included them in my filing and advised my payroll dept to stop the automatic payments. So, back to the letter received. Purchasing Power is trying to tell me that they are a "secured creditor" and that I must either sign a re-affirmation agreement ( which they enclosed) or advise them where to pick up the merchandise. Here is my question. If they disagreed with my listing them as an unsecured creditor, shouldnt they have shown up at the hearing? Are they just trying to scare get me to sign an affirmation? I pawned the IPOD and do not even have it anymore. Do I need to be worried about anything? Thank you for your help.:p


Normally, creditors have a certain time limit within which they are required to challenge a debt if they don't want to lose their rights of collecting it. If they have missed their chances, they can't come back to collect the debt once you get discharged.

yes they should have shown up at the hearing.i would give that to your BK attorney,and let him handle it.you have nothing to worry about.if they keep pressing then they are the ones who will have to worry.
