i'm looking for info on bk , it looks like i can file ch-7 , i took an online means test. my question is when i go to see a lawyer do i have to take utility bills , trash , ect . if i plan on using the standard deduction, if that what it is called . I'm 85000 in debt both my cars arfe paid for but not worth more than 3000 a piece
i make 4600.00 per month have 4 kids , my mortgage is 1100.00 i have no equity in my house , i am current on payment for house and want to keep the house is that possible


My attorney was not interested in any of my bills at the consultation. He just wanted a genereal idea of where we were at. Depending on where you live, the value of the cars may be a problem. In Florida, you are allowed $1000 equity in a vehicle, per person, if filing jointly. If they go over, then you may need to cover the equity in your other exemptions.
I am keeping copies of every bill I get. I am scanning and keeping a PDF of all of them, and all of my paystubs and bank statements. I would rather have more information than I need, than have to try to find it later, when it may not be so easily accessible.

Go into the initial consultation with your attorney well-prepared, to avoid having to ask questions later. Sit down and write down any and all questions you feel you need to ask, no matter how large or small you feel they are. This is YOUR financial life you're discussing with the attorney, so there are no "right or wrong" or "stupid" questions. Every question is valid and deserves an answer.

Write down any and all assets you have - house, car, boat, camper, vacation home/cabin, hunting property, farm property, rental properties, any high-value collectibles or luxury items (fur coats, jewelry, etc), life insurance policies, 401(k), etc.

The exemptions vary from one state to another - you will be allowed to exempt a certain percentage of your assets, which your attorney will be able to fill you in on.

I just went to see an Attorney this past week to file for Chap7. I had also over the past few months been trying to mod my home loan so I had all my Income and Expences figured out. I went in with them all listed with my CC bills. He said to me he was impressed, most people come in not really knowing 1/2 the stuff he asked for. So I say just put together a list of all your bills and what you spend you money on. To be frank if your at the point of Chap 7, 13 you should already know where you stand money wise and where its going.
