I have defaulted on few student loans. Can they be discharged through bankruptcy?


Student loans both private and federal are nondischargeable under the bankruptcy laws.If these are federal loans in default, consolidate them thru the WIlliam D Ford Direct Loan Program....you will automatically be assigned to the Income Contingent Repayment plan, a very affordable way to repay them. If they are private, good luck.

If they are private, just hold on. Bankruptcy rights will one day be returned to private student loans after they were so sneakily stripped away in 2005. Justice always prevails in the end. There are too many borrowers defaulting for this madness to continue much longer

From what I have read, it is not likely to happen anytime soon. However even in the pre 2005 days, you had to be in repayment status for 7 years prior to filing bankruptcy. If the laws change, the lenders will go back to suing within the first one to two years of default.

I am not going to get into the justice part...
