Wrong BK Filing
Date: Wed, 07/15/2009 - 15:11
Hello, had a quick question. I had delcared bankruptcy and my 60 day wait period is up on july 27, 2009.
My dad had the same name as me but with a different middle intial. He has a mortage loan with citi financial. I had a credit card with citi bank. When he talked with citi finacial they said that he had declared bk on the mortage. Which he did not, I did on the one credit card I had with them.
They asked for a letter from the lawyer proving that it was me and not my dad. My lawyer sent over a letter and they got it.
My dad got a different loan with better rates to pay off citi finacial. The new loan company called to get a pay off amount from citi and they said that the loan has a bk on it.
Does my dad have any type of legal action that he can take toward citi for still after receiving what they required, saying this amount has a bk on it which is doesn't and they have no proof that it does.
I don't want legal advice from here but was interested if this is something he can pursue?
Thanks for any help

Probably not. Sounds like a situation that will just take time
Probably not. Sounds like a situation that will just take time for the banks to sort it out. I seriously doubt that there is any action to take unless the bank does not straighten out the name on the account.
