bill collector trying to collect on an old debt

I live in California and I have had a bill collector calling me at home regarding a debt that dates back to 1997. I have not had anyone trying to collect on this bill for almost 10 years and now all of a sudden I keep getting these constant phone calls saying that I owe some company several hundred dollars. Does this fall under the statute of limitations for CA and is this company able to contact me after all these years?

Welcome to the forums. It seems that your debt is past the Statute of Limitation period. The collection agency can contact you for recovering this debt but you can inform them that it is past the SOL period and thus, you can't be legally forced to pay it.

However, as this debt seems to be past the reporting time in your credit report also, please pull your latest credit report from the three bureaus and see the latest status of it. I hope that this debt should not appear in your credit file.

Ben,
This is a Student loan, that Allied is taking out of my Soc. Sec. I just read there is NO SOL on Student loads. But, can they take money out of my Soc Sec.without notifing me they have taken this money,waiting for two weeks after the money was taken out,to notify me. Also this is under review by the Fl. dept. of Education, as they had me attenting the wrong school, signing the checks for me, the teachers were unacredited, and they closed the school (One week after I left) and opened back up under a different name. ...I only attended 1 semester, plus two weeks.

If it’s an unauthorized debit, then you should get a refund. But if the school has authorized them to withdraw money from this account, you will have to write them back and give a different account number.

Also, the collection agencies will keep contacting you until the debt is paid off. Since it has already been charged, you might not have any other choice.

You should contact Fl. dept. of Education and inform them about this situation. If you get a written note from them in your favor, you won't have to pay it.

What do you do if an old debt that has passed the SOL suddenly appears on your credit report and then an new agency (that is really the old one under a new name) is trying to collect. It had already fallen of my report and now it is back
