Getting the Job After Bankruptcy

I filed bankruptcy in October due to a growing debt and fear of ending up in civil court over my bills. This was the best thing for me to do overall, but now I am looking for a new job, one that does a credit check. I have worked for this company in the past as well and have a good history with them, but now that it looks like I will be a re-hire, I am worried about how my new credit status will look to them. Will this keep me from getting my new job? You thoughts, please. Thank you!

Welcome to forums. Under TITLE 11, CHAPTER 5, SUBCHAPTER II, ?? 525 of US Code, no private employer are allowed to take biased decision WRT employment only because the person had filed bankruptcy and it is there in his credit record.

However, some government unit may not be willing to offer a higher post to a person having negative marks in credit file. Or you might not be considered eligible by the institutes that are involved with financial brokerage, loan etc.

Also an employer is bound to inform you if your credit goes against you. If they don't, you have the right to ask the reason. I would also suggest consulting a lawyer to know your rights in details. Best of luck.

May I know the type of bankruptcy you have filed? If it is chapter 13, you are still paying towards your debt account and thus, you are showing improvement in your credit worthiness.

Apart from this, you have worked with this company in the past and have had a good impression in front of them. Bankruptcy won't be a hindrance if you gave them good results in your work.

I don't understand how a company can deny you of a job, because of something that is on your credit report. I applied for a job that did a credit report check and the manager of the place even stated that he's had to deny someone employment because of something that they found on the applicant's credit report. Isn't that discrimination in some way or another?

I've heard of a couple of reasons why. For one, if you will be working with money, they want to make sure by looking at your credit report, that you wouldn't be tempted to steal money because of your financial situation. Also some companies outlook is that if you can't handle your own money, they don't want you handling theirs. Especially if this job has to be with a manager position. They also look to see how well you handle your own responsibilities, if you can't then they don't want you handling theirs. These are a few of the reasons I have heard about as to why they run credit checks.

That sucks! I guess I should stick with my marketing major then. Was thinking about changing it to finance, but it won't do me any good if I should apply to a company that does a credit report check when doing a background check on me. I don't think it's a bad idea, I think that they should look and see if you are making progress after the discharge of your bankruptcy and not the bankrutcy itsself. Thanks.
