I have a past debt of about $400 that has not received any payment since quite a lot of time. Now, the company is calling me up and threatening of filing a suit if I don't pay them at their mentioned date. My financial situation is not allowing me to pay that amount within the deadline put by them. They have made my condition worse by adding that they will not accept partial payments at any cost. Someone told me that if I pay $100, they will not file any case against me. I have come into this forum for your advice so that I do make this situation worse. Any suggestion from you will be greatly appreciated.

Hi Summer H

Welcome to the forums.

If you are sending money to the company, you are doing a good thing in improving the status of your debt account, but this does not mean that the company can never sue you at all. If they want to take legal actions against you, they can do it. But usually they don't do as because they are getting their money without suing you.

Try to send a larger payment and after you have done it, place a call to the company and tell that you have sent an amount that is presently affordable from your side. It is because of your hard times that you are not able to make the full payment now and taking legal actions against you will not help in recovering the money any sooner. I am keeping my fingers crossed for their positive reply.

Good luck

Hi scpalmer5

Welcome to the forums.

The creditors are threatening because they are worried of not receiving the money from you. Talk to the lenders and explain your financial problems. Since you intend to pay the debt after your financial problems get solved, you need to convince them for an affordable payment plan. Please read the thread below for a better understanding on this situation.
