creditor calls at work

Is it legal for a creditor to continually call a person at work, and talk to whoever answers the phone about your situation? I have notified this particular creditor (a small loan company) in writing that they are not to call my workplace. I have also sent them written confirmation that I am working with a credit counseling agency who they will be getting a proposal from and have given them that contact number. They called me again this morning saying they could not reach the credit counseling company (this could not be true - it is a 24 hr. number) I also told them while they were on the phone not to call me at work. They admitted that they had gotten the written request, but said they would continue to call. I really thought this was illegal. Does anyone know for sure?


it is a violation if in fact they have recieved your written request not to call at work. Contact an attorney in your area.

Hi Sharimeri,

The creditors should not call you repeatedly for recovering the debt especially if you have involved a credit counseling company for this purpose. Inform the consolidation company about this call from them. The consultant will negotiate with the company and arrange payment procedure for you.

When you write a cease and desist letter to the credit company, make sure that you leave them room to contact you through written communication only. If you do not mention this statement in writing, they will assume that you are avoiding this debt and will take undue actions against you. Talk to your consultant also in this matter and he will guide you in the right direction.

It is not a collection company - it is the company where I originally took out the loan. I have in fact sent a written request and they are refusing to honor it.

Even the original company cannot call you at work if they know it is inconvenient or not allowed at work. You need to contact an attorney and show proof that you have asked them not to call your work. They do have the right to call you at home and do not have to abide by cease and desist, but they do have to stop calling your work. If you get fired over their calls, they really won't get paid. Have you contacted the consolidation company about this? Maybe they can help you by calling the creditor and getting them to deal with them and not you.
