Wrong capital one entry - Guilty until proven innocent

I have a bad debt listed by Capital One that is not my account. I have tried twice to get this removed to no avail. I have only had one card with them, which they used a cutoff of my application signature to respond with the last time.

Question? How do you prove it's not your debt when you never had it to begin with? Especially with one of the highest rated (worst to deal with) card companies?


Have you asked for validation for the account they are talking about.

If they do not provide validation on the account they are trying to collect on and prove that it belongs to you, then they have to remove the item.

If you write them a letter stating that you are disputing the charge and they have 60 days to send validation and prove the debt is yours, or otherwise remove the item from your credit file.

Hi Hc,

Welcome to the forums. Have you sent a letter to the creditor stressing on the fact that the said debt does not belong to you. You can write a letter to them in the following way.

Please return a report reflecting the result of your investigation. Should verification not be provided within 30 days, I expect the above mentioned entry(ies) to be permanently deleted from my credit report.

There is one thing that I will like to clarify. You said that you have not used this account and still you have a debt on it. I will like to ask you whether you applied for this account during that time. Usually, if you do so, then the account is not considered to be closed until you inform them about it and as a result, it adds up with all the misc. charges that you are not aware of. The credit card account is only considered to be closed by them when you return them the card diagonally cut and inform them about closing the account.

It just bubbled in my mind and thus I brought it forward. Maybe, this may not be the case with you.

This is so true. I have a credit card that is dating back from 1999. I am soooooo lucky I have no been incurring interest on this. The credit card is still active, and I just found out about it. Soon as I start making payments on it, they'll send a new card.

OR...I have just pay it off and close the account.
