Check Recovery Agency Prosecuting Me in Missouri

A Check Recovery agency is trying to collect money from me for nsf checks to a local gas station. I haven't been able to pay them yet and they are threatening to prosecute me in 10 days? Can they do that? They are not affiliated w/gas station.


Hi Nomorph, I may stand corrected on this but its my understanding that once the checks were returned for NSF, the gas station hired this check recovery agency to collect the money for them. They do everything in their power to get the gas station their money for the checks. At a certain point, if they are unable to collect, they then pass the checks back over to the gas station and at that point, they can issue a warrant for the bad checks. If at all possible, you should go ahead and take care of these. I wouldn't wait the 10 days to see what they will do or won't do. My sister in law had a warrant once for writing bad checks.

A business can prosecute consumers for writing bad checks. Bad checks charge a high toll. The account holder might have to pay penalty to the bank and to the business house. Moreover, he/she might be taken to court too.

If you have nay doubt about the Check Recovery company, contact the gas station and inquire if they have appointed them or not. Try to work with them, check if they can accept some payment plans.

If you have a good rapport with the local gas station, ask them to help you at this situation, encah your goodwill, if possible. Keep us posted.

I was arrested this week for checks at a gas station that had been laying in a check service. I was trying to get the money together and she had me arrested. She is my cousin. I do not know if I go on and pay her before we go to court if she can drop the charges. I have never had any legal dealings before. I hate to pay for a high priced attorney unless it is necessary. Can she choose to drop the charges if she gets paid???
