Sounds like you need a really good family lawyer, and he should have demanded a blood test. Now, he needs to get a blood test if he can get her to do it....will probably have to have a lawyer for that too. The only way to fix this will be in court.

Your husband can file a petition in the court to have court ordered blood tests on the children that he is paying support on. If the results come back that he is not the father, if I remember right, she will have to pay back all the child support which will involve an attorney.
Girlfriend is decent person
Girlfriend is a generational, life long welfare recpnt & sz she didnt knw all the paperwork was wrong. But to her credit, when proven *my* taxes were taken, she repaid me $600 cash (about 1/2) & appologized. But whos to say the kids are as thoughful? Any arrears will still be due after emancipation. Then the *definately not his* 3rd one is still under age 18. Attorney says get her to sign contract that if proven she presented falsely to original court, repay all monies. If correct about twins, keep only that part, repay 3rd child support. She agrees to pay the testing, my slow witted spouse is the procrastinator. What are my personal options? File taxes separate? Get the contract between her & myself for repay? A conatract doesnt clear the false records.

Most states also follow the common law marriage, as well as making the male parental figure in the household the father. Years ago, now that I'm older I'm understanding this, I knew of a female who had 2 children...but were claiming for 3. The 3rd, was not hers, but her common law husbands (from a previous marriage). She never really claimed the father as being present (even though he was clearly working and supporting the family with other needs).
I've sinced heard, that the mother of the 3rd child is taking the father to court for non-payment of child support, but also because the mother has learned the father was getting a check for child #3 from the step mother who was clearly not related to the child.
I don't know state laws pertaining to a non-parental mother claiming support for a child whose not hers. But I do know that the mother is seeing damages from a family law attorney.

So now what? 17 yrs ago he sign papers without reading them,out of fear. Let's say $250 per month, 12 months per yr, 17 yrs= $51,000 !!! Basic math. Basic logic says somebody on welfare wouldnt begin to be able to pay that back.
I think the state should pay it back considering they're the ones who made this happen under durest. On the other hand, he should have read the papers before signing.again, a contract for repayment doesnt clear his name from the court records. Now for the other side of this.
He's gone 17 yrs neglecting his(possible)children. Would they have had a normal non-welfare life if he had stuck around? My dad had 4 by my mother (his wife)&who knows how many behind her back. 2 were adopted out &the illegitimates were completely ignored.with no excuse for lack of money considering he was close to, if not well over being a millionaire. (some people should invest in the rubber plant industry- stock holders get free samples). I know 1st hand the mess that evolves from having parents refusing to be proper parents. My situation caused 50+ yrs of hate among many in the family.being treated like unwanted puppies could cause these kids to strike out in hate aginst my husband same as all my family wants my father to pay for his slacking in the dad department. I think tests should come first. Repayment second. Cleared records last. That's on the outside looking in. But i'm deeply inside because of the tax problem. That is where i need advice. I loose money from not filing married &i loose all money through the system because of the problems my husband has gotten himself into. Help!

I have a friend whose husband owed back child support before they were married, then she married him and filed taxes jointly with him...they did take all of their taxes and gave it to pay toward the back child support, so yes you should file separately, because they can and will take your taxes if you file jointly.

Any one have any suggestions for men who wives cheat, have kids &the courts make the husband pay although it is obvious fraud. I wouldnt want to pay support to kids i can prove arent mine. I dont want to pay some lady i dont know my tax money to feed kids i dont know. Get off welfare &work 2-3 jobs like everybody else, right? Fyi- while on welfare, birth control is *free* - whats the excuse? I still need advice on how to get my previous tax problem resended as well as getting the records cleared (cheaply).

my daughters dad was witha gal 19 years ago she had 3 kids while they were together. eh was in rehab when she conceived one and he was not there for the birth they foreged his name. this child is 16 the girl that might be his is just shy of 20 the other one that she said was not his is 19. she filed for suport several times and was denied until paternaty was astablished now after all these years she moved to california and they granted child support no paternity tests. he hasn't the money to fight the state and she is taking away from my mentaly retarted daughter with many health issuse for childern of hers that are grown what can he do HELP

Wow most states require a DNA test on all child support cases. I know in KY, unless you are married, a DNA test is ordered at 6 months of age. I would look into seeing how much DNA costs because I know where I live if you all been payin child support on a Kid(s) that are not his, then the state has to reimburse you all of that money he has paid into it. There are lots of places who do DNA tests for only a couple of hundred bucks. Which may seem like a lot, but if they aren't his children, should your taxes be seized? HECK NO! The government took all my taxes(not my husbands but mine) for his back child support. Talk about being peeved off!
