If I own land in Florida, jointly with my ex, and I also have a lien on that land for child support (child support order is from CA court - and lien was sent from California DA - to Florida) arrearages in an amount higher than 1/2 of the appraised value of that property, how do I take title on the property. Or am I stuck waiting for him to decide to sell - or does he have to die first?

It seems logical - that if he owes more child support than the value of his interest in the land - that I should get the title to the property and be able to liquidate in order to have money for my children's school expenses. Bit nothinig about court has ever been logical.

Welcome to the forums. Does your ex-husband owe a lot in back owed child support. If he does, you may want to contact the FOC. However, the FOC does give pitty to fathers (sometimes), and will only make them pay a percentage (of what is owed) each month.

Contact the FOC, will only provide you with advice regarding the land. They may launch their own investigation, and make him either sell the land, or start paying more because of his assets.

Did you have an attorney during the start of the FOC proceedings? You may want to contact an attorney, as they can always offer advice over the phone for free.

Be very careful what you sign. YOU WILL BE STUCK! My mother just wiped out $18,000 in back owed child support, and she wishes she never did. It was suppose to be a fair deal, and she ended up getting the sour end of it.

Regards-
Mike
