I have just received phone calls from these people regarding a credit card debt. They claim they sent verifincation of the debt; however, I let them know I have never received anyting and would like something sent in writing to me. They said they were a 3rd party on this debt and that they don't own it. They tried to pressure me into making a payment, and I told I would like to send a letter of validation and both times I got hung up on and ended calling back to get this information. Was asked why I wanted to send a letter. I expland to them that my credit is showing HSBC as the owners of the account and I wanted to get this in writing before I continued. They told me the account would end up being charged off after 14 days and then I would not be able to make arrangements.

Do they still have to comply with the validation letter I send, even though they say they sent information to me.

I would like to know if I am on the right track.


Anyone can correct me if I'm wrong - but if they don't own the debt, I'd be weary of what they say. Have you contacted HSBC regarding the debt? See if the actual creditor can send a validation letter and also ask if you can work through them instead of the 3rd party that is calling you. HSBC responds well to my requests so perhaps that is a sign that they are easy to work with!

If they have sent the letter, ask them to verify the address used. You will get clear if they are lying or you have the right to request validation. In any case, send your debt validation letter through certified mail. This is a proof for knowing the details of the account and paying to the right company.
