got a call from allied interstate stating that they were going to file charges agianst my wife she set up a payment then cancel it cause her atm card got stolen so she closed the account. she called them last week and told them that the account was close then the silly woman call yesterday and say why she close the account i told that her card got stolen and she told yall that her account is close. so is it against the law for them to threaten you like that just need a lil help before i try to file a law suit with them.. thank you


Hi, welcome to the forums!

I'm assuming since you were first willing to pay this debt, that it's valid (and you have received verification). Have you tried to work something out with Allied? Threatening someone is just a scare tactic, and is illegal. File a complaint with the BBB, and the FTC. Violating the fdcpa laws are not something to be taken lightly, as many collectors think they can abuse the system. Please let us know on the outcome.

thanks for the info. we are trying to work with them we are doing debt counciling and they keep saying that they don't accept it. but i was told by a lot of companies they just say that cause they get paid off of commission. then my wife me and told me that they want to try to settle with monthly payments. you think they want to do that cause i told them that they harrasing us and by them threaten us is against the law you think they doing that casue they don't want another law suit

Have you tried to arrange something with the original company? Dealing with the original creditor will be much easier for you. Dealing with debt collectors especially allied interstate who regularly violates the federal laws can become only tougher. Besides, you want to make sure that they will be posting your payments towards the debt account since many have complaints against them because of their fraudulent activities.
