Set them a DV letter on March 25, 2006.
Never did get validation from them.
But yet, they decided to send yet another settlement offer, without bothering to validate their claim.
Would another letter be in order? Or would that be asking to much of them??
Or is legal action of any sort a possibility?
If so, what?
Because they're still attempting to collect on an UNvalidated claim.

that in regards to your settlement offer I am writing for validation. You must have not received my first letter, so I am giving you another 30 days to validate, before I ask for this to be removed from my credit file.
Something along those lines. If after 30 days you still don't hear anything, write a letter to the credit bureaus, and inform them of the situation. Provide a copy of the first letter if you have it, to both....the collector, and the bureau.
By the way, did you send the first letter certified?

it is important to remember that the fdcpa does not place a limi
it is important to remember that the fdcpa does not place a limit oh how long a collector can take to validate a debt, meaning if they pop up in a year and validate it that is legally good enough. If the settlement offer is fair, then tell them you reserve the right to accept that offer at such time as they do provide your with the requested validation ( you could also go the rout of they are violating the FDCPA by continuing collection activities after you requested validation, even though they failed to provide that validation).

I am having a problem with this company I have a debt on my credit report that does not belong to me never owned a vehicle of that nature "ever" they asked me to settle for less than the amount on my report but it is not mine and it has been in dispute for two years now they I also informed them that I have never recieved a notice and they told me if I pay then it will go to the claimant and they would have to take it off. but it will not come off until it is paid. I asked for verification or notice of this charge and they didnt even ask for my phone number or address. what is my next step. I am at a stand still on my credit. thank you

To KChan: Definitely send another letter! In it state that they are in violation because a settlement offer is still collections. Demand validation again and if/when they provide said paperwork, that you will then consider their offer, but not before.
MsKim: Send them a DV letter. Once they get it, dispute the tradeline with the credit reporting agencies. When it comes back as verified, you now have them on one violation: verifying ANY information or updating any information on a debt in dispute is considered a violation.
Then you send them another letter, in it give them 15 days to produce this information or you will serve them.
You could also send the credit reporting agencies a letter. In it explain that you have been asking for validation from this company and that they have not been able to produce anything. Ask for all the information that was used to verify this account. By law they have to give it to you and if they do not, you can sue them as well.
Stay on top of it and if they don't comply, file suit...its at least a cool 1000 bucks in your pocket plus they HAVING to remove the tradeline.
