Simms and associates ?

Hi , I'm new here and have a question . I received a call today from Sims and Associates today . They were trying to get in touch with my next door neighbor . Are they really allowed to call me ? And how did they get my number ?

Yes they are alowed to call you and the only way they got your number is if whoever they are collecting the bill for has your number. For example if it is a loan company then you either gave your next door neighbor permision to use you as a reference, or they did on their own. If it's a hospital bill then your next door neighbor gave them your number as an alternate. Whatever the case maybe they got your number because the person they are collecting for had it. I have the same problems with my stepdad. I have bill collectors call all the time for him. What I would do is tell them that the person they are looking for does not live there and to please take your number off their list. Sometimes this works sometimes it does not. Good luck

Pro, Simms and associates is a collection agency so surely a cease and desist letter will be your best move. The collection agencies must not contact you after receiving this letter from you. This is one of the federal laws and all CAs must follow it legally. You will find a letter in this website and send it to their mailing address through US Mail. Don't forget to get the receipt signed by them. This will be your proof that the collection agency is legally restricted from contacting you in the future. If they break the law, you can sue them in the court for the violations of the fdcpa laws.

Are they for real ? I have heard many bad things about them and that they are a fraud ?

They don't always get it from the party they are collecting from. Many times these companies use skip tracing and I have even heard of some using private investigators to find people...they manage to get the names, addys and phone numbers of the people who live around the individual they are trying to contact and will call them.

collection agencies for the most part are NOT paying for private investigators. They have enough skip tracing tools at their disposal. We used to pull lexis nexis....you would be amazed at this info it contained.....family members names and phones, spouses info, tons of stuff. A next door neighbor is a simple cross directory check...really basic. I used to do a lot of my own skip tracing....I would call libraries, the local bar, bowling alley, even creditors. I had access to DMV too.
