Need advice!

I've been paying on a Providian credit card account through an attorney's office (who's collecting for Arrow Financial who bought it, but depositing the funds into a Collect America account)for a number of months. In trying to keep them off my back, because they keep threatening to take me to court, I've made several payment arrangements, which end up putting me behind in my other bills (mortgage, utilities, etc.), and as a result, I default on a payment so I can make a payment towards my other bills, and then their office calls and yells and threatens me again. The original amount was around $7300 and now I owe $1944, which they want me to make two payments of $972 each this month. My question is if you think they would go to the effort and expense of filing a lawsuit against me if I only send a partial payment this week and not the full amount, so I can make payments toward my other bills. I'm assuming that since they are so close to getting the account paid off, that they are not going to go to the trouble, but I don't want to assume to much. I know that the legal assistant is going to call me and leave a nasty message like she has in the past. She says she has "put her neck on the line for too many broken promises" (like she's doing me a favor). By the time it would get to court, the account would be paid off, and also I don't know if they would want to spend the money to file the case, serve the papers, travel time (because their office is 5 hours away, etc.) So I just wanted to get your opinion on what you thought, because I'm just not going to be able to send them the full amount this week, and I know the legal assistant is going to go ballistic. Thanks for your input!!!

Guest,I suppose anything is possible,but I don't believe they will take you to court.You can't put yourself in a bind and not pay for the basics of life,trying to pay them what they want. I don't know of too many people who could make 2 payments of the amount they want. I would send them a payment,whatever is comfortable for you. It may be tight,but it shouldn't deprive you of the basic necessities. Send a letter with the payment explaining you want to get this paid off,but are unable to pay what they want,but are inclosing x dollars. As long as you are making payment,you can show this to a judge,if,and when this goes farther. Good luck...Karen

Thanks Karen. I'm going to take a chance and just send them a partial payment. That's all I have. I had no choice, because I had to pay on my utility bills. I can't live in the dark without water or phone, plus I've been putting off getting mine and my husband's medications refilled. I just decided they are just going to have to live with what I can give them at this point. They've almost got the total amount, so hopefully they won't go to the trouble of filing for the remaining balance. I would think a judge will look at them as very greedy and impatient people. I have all my paperwork, letters, payments, and even recordings of the phone messages the legal assistant left me (even the one where she refused to provide me with a debt verification-I owed the debt, but the amount doesn't match what is posted on my credit report, so I wanted a breakdown of what the charges were, she refused), but I would rather just get them paid and out of my life.
