Well,I'll try to make this as short as I can! I had been dealing with LVNV for over 6 months,sent dv letters,follow up,etc.,and no reply. All they did was pass it among their many agencies,so I did they same with them,no response. Today I got a call on recorder from lady stating I need to call back, this is an emergency,but she isn't threatening me,but if I don't call within 48 hours they will take action. So,just for fun I called. Turns out it is Universal Fidelity-who now says they are also under the LVNV umbrella. It started nice-then got ugly. She Said"They tell me at Resurgent that you are well educated in debt" and we know where you get your info. I said,where? She said,that website called debt something or other!!She never mini-mirandized me,said she isn't supposed to give me any info,just my husbansd, but she was doing me a favor,yeah whatever!Then she said she was collecting on Sears behalf. I said this debt was charged off then sold,so are tou telling me you are collecting on Sears behalf? She says yes,so I say,ok I'll call Sears,she backs down. She starts telling me she knows all I'll do is send a dv letter,and they have validated,I said, I don't know who you are, what"s your address. She refuses,so I say send me what you're proposing-she offered a settlement 3 different times,different numbers. She says we'll file a judgement a garnish your pay.Also told me they were charging $135.00 per mo. on interest,so since Jan. it's gone up tremendously(Balance) So what I'm going to do is, make copies of all the letters for dv sent to LVNV,et.el and write another letter to Universal Fidelity for DV.She sai,that website is giving everyone the wrong information,and it just pisses off the collector,and they will file againt you.So I guess they are watching!Was gonna quit using my name on the forums,but if they're watching the forums,won't take them too long to figure out who I am. Sounds good for You! :) And sounds very bad for collectors! :twisted: when they realize that people are becoming aware of their legal powers. Bossy, don't let them get over you because never know, what other shady tactics they might use. Ultimately, you are right on what you are doing. It's legal. Period. Go ahead and step them off your back by a debt validation letter. Try to work with Sears, they might be a lot easier working with.

Thanks,ArDen! But Sears charged it off and it was sold in Jan. 06.The stupid lady even told me I should send my dv letter to Sears because they are the ones with the info. I said, I thought you bought it-she says yeah-what a dip!She also threatened to call my husband at work. I told her,I'm putting you on notice he can't receive calls at work,she says,well,we might have too. So I said,go ahead,if he looses his job,we'll go on welfare and file hardship. My oldest son was sitting there listeneinig and said,you probably really pi**ed them off now!! ...Karen

:lol: When did this account turn delinquent first time? Just check the timeframe for confirming the legal reporting period under the FCRA laws. Continue with the debt validation process on the collectors. Send a cease and desist letter to the CA and force them follow the legal part. Put them in troubles if they violate the laws after receiving your cease and desist communication.

Collectors want to be over us. They don't want us to be aware about the legal things that can hamper their shady collection tricks of making money. You can expect something else from them that can be shady just like their previous attempts. Always remember, you are doing what is allowed by law. Don't let them intimidate you with their wrong collection practices. fdcpa link will help the newbie in knowing the legal rights.

Im flipping them the double deuce!

To all the collectors who have lied, filed false negatives on credit reports, harrassed, repeatedly called a number that was wrong, or tried to collect on a debt that wasnt owed .... Your a buch of low life scum sucking frauds!

To the honest collectors, kudos for not letting greed get in the way of helping people.
