Hi. My husband and I recently had a judgment against us and I need some advice/or places to look.

Ok we sold a home 4/06 shortly after the well 'failed' although the buyer had signed a hold hamless, and as-is and had waived any further inspections (we had had well inspected in 1/06- it passed)we are being ordered to pay for the well ($2k) The judge told us we could file a claim on the well inspector to recoup the damages (but we would have lawyer fees)but we mauy not have judgment in our favor- as the plainiff sued ius and the inspector he was w/o judgment.

The judge offered a payment plan as 100/mo we told him we would be unable to pay that. I told him we have a family of 5 and make 26k/yr so our budget was very tight. He told me that the judgement takes precident. He informed us if the judgement was not paid in 21 days that we would have our wages garnished.
We can not afford 25% garnishment. Our home is 1600/mo and rest is food and utilities--- what can we do?

I called the legal sect. for the judge and she said she didn't understand the verdict, but that doesn't reverse it...


go to the courthouse and file an appeal..You will be able to plead your case before a magistrate. Bring check stubs and w2s with you. You may be able to take a hardship reduction.

Sometimes consolidation comapnies can stop garnishments. Chpt 13 bankruptcy does as well, but I don't reccomend that unless as a last resort.
