Validation Request after 30 Days?

I received a notice from NCO Financial regarding my Bank of America credit card acct., which has been turned over to them. This notice was received towards the end of Sept., early October.

I am usually so good about keeping all paperwork received, but can't seem to find this notice. These people are calling me at work every few days and I was advised to send them a dispute validation letter to get them off my back, because there's a high probability they won't comply with the request. Well, I'm thinking it's been more than 30 days since the notice was received. I'm assuming I can't send this letter now? I know I can send a C&D, but I would also like to halt the collection activity and have them provide me with additional info.

This acct. is in my settlement program, but I have just started it and don't have funds built up yet, so no way I could settle the acct. for quite some time unless I happen to come into $5,000 unexpectedly, and the settlement company aren't really doing anything at this point. I've heard NCO are horrendous to deal with and can ruin you, which I want to prevent.

Any advice?


NCO might practice rigid collections on you because you didn't send your dispute letter within the 30 days timeframe. They have reasons to prove that you have accepted the debt to be legit. Even though you considered the debt disputed, they will say, it was your responsibility to prove that within the legal timeframe.

Your only move is to settle the debt with your debt settlement company and that can be done after you have enough money into your account. You have to be fast on this arrangement before they try to sue you. You have to collect some strong points to your favor. Unfortunately, your case is weak from where I am seeing. I am sorry if this is not what you expected.
