When CA's don't negotiate

I am taking up the fight with collectors. I have several collections due to unemployment a few years ago. I was activated after Sept. 11 and when I returned 2 years later, my company laid me off. (that's another battle). Anyway, I was unemployed for a year and shy of creditors, mostly didn't have the $$$ to pay all the bills except food house and cars, (go figure). Well I send the collection agencies letters asking for debt validation. If the debt is valid I send them a payment plan offer with a partial payment in good faith. if they accept, no problem. What do I do if they don't? I usually include a quick story of my circumstances and throw in that any judge will see I made a good faith effort. But what do I do after that?

You will be able to make the payments directly to the creditor if they have not sold your debts to outside debt collector. In case, the debt collector is the only one whom you have to make the payments, get the debt validation in writing. You must have specific information that they are responsible to collect money from you. Here is a link to the fdcpa. This will make you informed about your rights when dealing with a CA.

Your payment efforts will be important if you are asked to prove in front of the judge. Have everything in writing so that the judge understands your situation.
