My daughters husband ran up a ton of credit card debt on cards in his name only, After apparently being haunted by collection he shot himself. Now some of the card companies or thier agents are trying to say that she is responsible for the debt.We do not live in a community property state. Her name is not on any of the cards as a user or co owner, Any thoughts as to what she should do. She is being harrassed by a collection company representing chase even after telling them not to call her home anymore.


I am sorry to hear about the loss of your son-in-law. Since your daughter doesn't live in the community property states and she has not signed jointly on the credit cards, she is not responsible for the debts.

collection agencies will use aggressive methods forcing her to pay the debts. Since she is not responsible, she can put a complaint with the DA's office and the Federal Trade Commission.

Your daughter should also send a cease and desist letter to the collection agency and legally stop any calls from them. If they continue to call, it will be a violation of the federal law, therefore, a class action lawsuit can be filed against the company. Start recording their phone calls to build up a legal case. Check your state laws whether recording is allowed secretly or permission is needed.
