allied interstate has just recently contacted me about some pretty old cc debt. The card went default in 1998. I think i made a payment early 2002 to a diffrent collection agency. I asked AI to send me a debt verfication letter. He says one is on the way. I also asked him about the SOL. He said everytime the debt is sold the SOL starts over. Does anyone know if this is true.


From what I recall seeing in the past, the SOL does NOT restart in account is sold. Only if you were to make any sort of payment toward the account in question.
SOL, IIRC, begins with the last payment made to account.

Send AI a DV letter, Certified Return reciept.
Make them prove the debt, before you make a payment.
I just sent out a couple more letters to AI, as they failed to provide half of the requested details!

SO does anyone know if the statues on a debt restart when the debt is sold? I also just found out that allied interstate is trying to collect my debt for LVNV funding. Anyone know how this works. They also said something about Sherman company! All i know is that the card defaulted in 98 and I made a payment in early 2002 to some random CA

Have you checked this debt reported in your credit report? The latest payment will make the debt current and the SOL will be calculated from that day. One CA can hire another or sell the file to them. Get your debt validated by the CA that is doing collections at present. You must make sure that your money is going to the right place and they are authorized for the collections.

OK i just pulled my credit report. The debt that the CA are trying to collect on are not on my credit report? The debt went in default in 98. I did make a single payment in 2001 or 2002. Im guessing that since the original debt went bad in 98... so the 7 years is up and it cant be reported on my credit report
