Has anyone dealt with the above CA? They called me regarding my checking account which was overdrawn. I owe $600. I know the debt is mine. Should I still send a DV? He told me they did not buy the debt, just collecting on the bank's behalf. He wanted me to send $200 which I cannot. I was unemployed for about 3 months and just started working again, allbeit part-time, and just getting back on my feet. He was rude, talking fast and I couldn't understand him. I asked him to slow down which just caused him to talk louder. Then he started asking personal questions and I hung up on him. I was going to offer $25 a week or $100 a month. Should I send a payment plan offer? Should I send a C&D and a DV letter? Thanks for any advice.


Hi scooter! This is only my opinion. I was once in a similar situation. A bank usually does use an outside agency to collect on their behalf. A C&D letter would only stop all collection calls, letters, etc. until they decide to sue you for the balance, then at that time, if it happens, you'll be notified. If you could call the bank directly and talk to someone there, they will be willing to talk. Right now they think they arent going to get any money from you. They had to get a third party. If you are indeed willing to pay, call them directly. To outside agencies, you are just a paper on their desk, thats why they talk fast, and they could care less. Hope I helped a little bit.

I think I going to write and offer a payment plan directly to the bank which was my original intent before my financial fiasco started. I do plan also to send a DV letter to Nationwide. Does anyone have a copy they could share? I've looked all over this forum for one. I read on the internet that back in the 90s Nationwide got fined big time by the FTC for violating the fdcpa. Thanks for letting me vent. These things just upset me.

Insert your info and send this DV letter to the collection agency. They must prove their authorization to collect the debt before you send them money.

Call the bank and work out payment arrangements. If they accept your payments, they will pull the file from the CA that was hired for collections.
