I am getting calls from Paragon Way and Asset Acceptance for a person with a same last name (it is a VERY common last name) but a VERY different first name. They leave messages on my answering machine, i have never returned a call. Asset Acceptance says that just by listening the the message on MY answering machine I am claiming to be the person they are calling for. What do I do.....keep ignoring them? I have no past due debts.

jetprincess: Asset Acceptance is full of it. Send them a cease and desist letter for your phone number and document every call you get after that. If they keep calling seek legal counsel. You are never claiming to be the wrong person by listening to YOUR answering machine. I would even save the messages for future evidence of their conduct if the messages contain violations of the collection laws. This is the very type of abusive collection practices that usually cross the legal lines drawn by the fdcpa.

This may be the typical scenario where the collection agency can't find the right person so they find the person with the same last name who lives closest to the last known address of the real debtor. Then they harass you until you pay, tell them where to find the real debtor, or change your phone number. I've seen it many times before.
