Need Advice ASAP!

I am back and forth with a company, Patriot Rims (located in Virgina) about a remaining balance on my account.

They are very unprofessional and left messages on my husband's business phone stating he was past due and he needed to call immediately, etc. I was furious that they left this type of information, so he responded in a polite manner how shocked he was regarding their behavior. We also inquired about a letter we received on their letterhead, that was poorly written and was signed (typed) J. Goldberg, Counsel.

I asked that they provide the registration# for this attorney, so that I could verify that this letter was indeed valid (I supspect they used this as a tactic for collection) and I was told that as a customer it is not my privalege to request information regarding any member of their network (they operate in 50 states).

So my questions are:

This loan was to finance rims - do they have to be licensed in every state in which they provide financing to the residents?

Is it my right as a consumer to request information if I feel something is false or misleading?

Please HELP!


If Patriot Rims is the original creditor they don't have to operate under the guidelines of the fdcpa. However, I would suspect that if an attorney supposedly signed their name to a document you should be able to communicate with the named attorney. If Patriot Rims isn't willing to provide you with the full name of the attorney in question, then check with your state bar association or do what Mishele suggested in the previous post.

I have a letter fired up ready to go to my AG, but I just want to be sure I am not out of line with such a request...believe me if you saw this letter in NO WAY would this have come from an attorney's office. It is not even signed. It looks as if someone just completed a template and this name is false. I have checked the VA and NY bar association and there are several listed in NY. All I requested from the company was that they verify that it came from a valid source.

I am asking the AG to contact the company to verify this information and will be providing the letter in question to them.

I guess it is suspicious to me because why would an attorney send me a letter when the collection dept continues to call and has no idea who I am talking about and that "they don't use attorneys for collection". Hmmmmmmm.....

Am I crazy or what?

Legal Council says that according to the fdcpa and Fair Credit Reporting Act, when requested, a company has to give you a copy of the agreement and statement and if they do not provide this then they are in violation and to report them to the following: OTS (Office of Thrift Supervision), FTC (Federal Trade Commission), OCC (Office of Controller Currency), and the Attorney General's office.
