Hello,

My name is Ed, I have recently been dealing with an attorney (amin assistant) that is working for Collect America they state they represent Arrow Financial but I called arrow and was told the account had been sold to collect America.

A little about my situation, I had a motorcycle loan from Yamaha through HSBC then I lost my job which made me drop insurance on the bike, the bike was stolen but I continued to make payments until I fell behind.

Last week I reached an agreement with the attorney to settle the $7,800.00 debt (including interest) for $5,000.00; The assistant told me that he was able to work that deal out because he knows someone on the "inside" and that "someone" wants to be compensated $300.00;

The assistant keeps calling and asking when I will be able to pay the compensation, I'm scheduled to make a $3,500.00 payment towards the $5k at the end of this week and the remaining balance on the 15th I'm at risk of loosing my job this month so I would like to know if I have other options because, rent is a priority over paying this debt. Is there is anything I can do since they claim to represent the wrong collection agency and the customer service rep is asking for compensation.

Ok these guys are collection agents so we follow basic rules when dealing with them.
1. Write debt validation letter and mail certified return receipt.Here is link:

2.In letter add paragraph to state that you wish all business concerning debt to be communicated by us mail.
3. Here is link to the fdcpa.Read it and become familar with it.It gives you your rights concerning collection and it is federal law!

4. You may want to check your credit report to see if they have been monkeying around with it.

5. Get familar with the fcra too.It is federal law that governs everything dealing with credit reports.

Yeah he keeps calling and telling me to "keep my word" and even though I'm paying $300 I'm still saving over the entire loan and of course to keep that compensation between us two because his "guy" could get fired...I know it's for him but, I've been playing it dumb just to get him from calling me.

Including the 300.00 that is just wrong.. and I would think that it is againt the law.. I would do what ever i could to record that transaction if nothing else.. It is Extortion (sp??) sorry spelling stinks..
But I would not pay the 300.00 without something to go back with.. or record the conversation when he is asking for the money... sorry this make me angry we pay enough in intrest and being bullied so the 300 gets me

Exactly, I'm going along with it and once this is resolved I will let his next up know (the attorney I think) and just to cover it I will let him know that even thought it was not him (the attorney) asking for that money directly, I will report the company to the BBB at least I hope to get that Ahole fired for trying to milk me.

Fired.. I think you would have a lawsuit.. I would think that you could do more then just get him Fired.. Call a Lawyer or better call your district Atty.. explain what is going on and get advise for a criminal case.. then I would go after a civil.. this is not right 300.00 "for his friend" can you record calls in your state? or do you need to advise the person on the other end???
Call a Lawyer right away and ask the questions.. You can not go to jail because you owe money and you cant get blood from a stone. so if you dont have a job how can you pay??? get legal advise be wise...

Well being you are a guest.. I cant PM you.. I am on this site alot dont always put my .02 in Because a lot more people here know way more then me.. But they did help me out when I needed it.. But please the guy works for the atty.. he is a agent for the Law firm or collection agency what ever.. this is just illegal.. It has to be.. as a Buyer if I take a little extra on the side for doing my job I can go to Jail... ( ever hear of the Litton buyer who went to jail for 5 years for taking money to grease the wheel).. Anyway just check with a lawyer..

Thanks for the advice, I have recorded a phone call but, I think in California you need to have the other party aware. (I'll google it). I tried signing up on the forum but I'm having a hard time finding the "register" link.

California.. CALL the Dept of Corp.. or the AG's office.. Call someone...please... I am also in Cal not for sure.. but it must be against the law and as a worker in California.. I know as a agent for the company they can get in trouble for my wrong doing and be here responcable for my actions..'You may get out of that debt and please I do not advocate skipping out on a debt but this is wrong..
