It depends upon the state laws on collections and the types of debts in question. The collectors don't need to go to the court if they are collecting for student loans or any other federal debts. What types of debts do you have?

An Attorney can obtain a Court order and freeze your banking account until it is established in Court how much the debtor actually owes.
The bank account holder is not notified until after the bank account is frozen.
