Asset Acceptance garnished my wages
Date: Thu, 03/08/2007 - 16:56
To start off this sad story the orginal debt occured in 1996 with bally's. I signed this contract not knowing anything about contracts and realized a week later just how dumb it was. So I went to bally's (keep in mind I never once used my membership) to cancel my membership. Which of course I couldn't cancel because I only had 3 days to do so and of course no one told me this. It had been a week instead of the 3 days.
I tried to talk to them and tell them I did not need this membership because I was going to college. They would not let me out of the contract. So of course I said I was not paying for something I did not use. Then the harrassing started until my father put a stop to that. I haven't heard anything about bally's from bally's or any creditor that might have bought my debt. Now here we are in 2007 I get notified by my employer that my wages are going to be garnished. I was flippin I couldn't for the life of me figure out who did this. I had just checked my credit report a month or two before and there was nothing for that amount on there.
So then I figure out who it is. So of course I am really upset. It had been almost 11 years. The address they have for me is still my parents address so I would have known if someone was really after me. I also have two children and live out of that state now. So if anyone has any suggestions or helpful advice I would so greatly apprecate it.
I just disputed the garnishment and also called for a motion to set aside jugement. The judge just set another court date even though asset acceptance was a no show. The court paper I recieved says scheduling order!! I don't have a clue what this means or if I need a lawyer which I really can't afford. Someone please help??

Brownsugar, They did a sneak attack and got a illegal judgement
Brownsugar,
They did a sneak attack and got a illegal judgement.Op,you are doing the right thing by forcing the motion to vacate. You will need to show the judge that the address they served was not a valid one.Once judgement is vacated, the debt will be sol. After you get thru this legal battle,go to naca.net find you a good consumer lawyer and sue the hell out of them in federal court for fdcpa violations.
