I fail to understand

How collection agencies think they can collect on a debt that is 13 years old and 10 years out of SOL.
The SOL in MD on a open end account (credt card) is 3 years.

First of all, I never had an account with the creditor. My first and only credit card is with Bank of America. I have never had or applied for a Capitol One credit card.

Second, it is a debt that was created in 1994.

Third, there is no record of it on my credit report and that is expected since I never had an account with Capitol One.

So someone please tell me, is there something that I am missing ? It has been disputed and they have replied with a letter stating the the same information and no more than the first letter I received. If there is something else that I should do please inform.

This is the second time something like this has happened to me since the first of the year. Am I on some type of "Chump" list or something?


happened to me awhile ago. I was sent a credit card bill and it wasn't even my bill it was my mom's. All of our names begin with D's and end in L's. Only middle names are different. I called the company and made them aware that I never applied for the card and never had one and was told that I needed to check my credit report and then send something in writing to the credit agency. That was never on my report they had the first inital and the same last name... I still get the same thing to happen all the time...

The collectors always have the rights to collect for a debt until it's paid. You have to make them aware about the SOL expiry and the reporting time period.

In your case, they are calling for the debt that you never owed. First, make them validate the account in writing. Show the FDCPA laws on validating the debt and make them aware of your consumer rights. You are not responsible to pay for a debt that never belonged to you. Send the DV letter and put the burden of responsibility on them.
