Do you give up your right to request debt validation if you did not respond to the letter with in 5 days. I have a collector suing me for a debt they first contacted me about 2 years ago. I have not heard from them since, thought it was passed on to another lender. I am not sure about the validation timeframe, is it real strict. I requested it after hearing from them on this second round, 2 years later. I haven't heard anything from them. In the summons they have a copy of the bill that is in the original creditor's name, not theirs. I am sending a 2nd request tommorrow certified to the law firm representing these jerks and one directly to the company. Does anyone know about debt validation enough to answer this. I have not paid them a dime yet. The last statement in the debt validation law states that . Section 809(c) states that a consumer's failure to dispute the validity of a debt under this section may not be interpreted by a court as an admission of liability. Since they are suing me, I would like them to validate the debt. Do they have to provide me validation at this point?


Thanks again cajun, I am finding some real interesting stuff on on discovery. Just have not found an example letter to you. Can I just write them and request that they send me all supporting documents in evidence that they have accumulated in this case? Can it be that simple or is it more involved?

Is there a time frame once you are served for them to actually take you to court or can this pending lawsuit linger over you head for a long time? Who sets the date, the court or do the ones suing you have to respond to your answer first? I sent my answer last week and filed it with the court on 3/2, still haven't heard anything.
