Hi All,

I hope there is someone out there that can give me some good advise.

I have received several phone calls at my place of employment from Mrs. Jacks @ Allen Lewis and Associates. No doubt this is regarding a payday loan company that they say i have defaulted on. However all of the payday loans i paid way more than i should have. The loan being defaulted is really not what i care about at this point. Right now i care about this woman harrasing me and my whole family. As many times as she has called me i have called her back and requested her to send me all the information in writing. She never does and then calls my family members with all the insane talk. Like the police are coming to pick me up if they don't receive money in an hour. I know she cannot possibly do that, however the calls are very upsetting to my mother, my grandmother and my sister. What should i do?


Read the fdcpa laws in the FTC website and be aware of your legal consumer rights. Allen Lewis sounds to be violating most of the laws. You can take legal actions against them by filing a lawsuit and recover the damages.

If it is permissible to record the phone calls secretly, do it. This will be a good evidence of their violations and present to the judge. It will turn the case in your favor.

As johnson said, what they are doing is illegal. They tried the same stuff with me. I found it best just to ignore them if possible. Don't even answer the phone when they call, if you have caller ID. They called me about 3 years ago threatening me and called my family. I have ignore them since and they have pretty much stopped calling me, except maybe every 6 months or so but I ignore them. They did call me here at work today but hung up when I answered the phone and called right back but hung up again. If your so inclined you can try and get an attorney that specializes in suing debt collectors and sue them.

I got a call today from Allen Lewis and Associates today regarding a payday loan in default. I have paid in fees alone and a small principle amount well over the original loan amount. They stated that my file was in the last stages and getting ready for court. Will this happen and what should I expect.

If this was from an internet loan, I don't forsee them taking you to court...All you have to do is provide teh judge with the copies of your bank statement showing what you borrowed versus what you paid and then the case would be dropped but It will never go that far because 99% of internet PDL's are operating illegally in all 50 states!

Well as far as my story goes, Michael Knight of Allen Lewis and Associates had contacted us stating that he was an attorney and that we were in possesion of stolen property and if we didnt pay him $1145 for a $95 violin his client would be pressing charges. As stated in the Fair Debt Collections Practices Act of 1975, I sent a certified letter to his office requesting that all contact cease until such time that legal action was being taken with exception of a verification of the debt to be sent to my home. Several phone calls later from him I informed him that he was in violation of the law and that I have filed complaints with the Florida AG's office ( address below ) and the FTC. Currently Florida is investigating them for falsely representing themselves as lawyers. The phone calls continueto this day.
