I don't understand how CACH can file suit against me if i've never recieved anything from them. Besides 2 telephone calls i've recieved i've NEVER recieved anything by mail from them. I sent a letter of validation back in November of 2005 and never heard back from them until recieving a citation in July of 2006. (although i did NOT send validation certified, i do however, have a copy of it) How are we expected to pay if I've NEVER recieved a bill or anything else for that matter? I composed a letter again, (will send certified this time) but otherwise plan on attending court and asking a judge this very same question. I still feel a bit intimidated by going to court but i didn't do anything illegal but get myself into a mess financially.

You should definitely show up in the court. Check the court date
You should definitely show up in the court. Check the court date with the local county where the case is filed and file your answers. You will be confirmed whether this is a legit case.
When you are standing in front of the judge, show all the papers sent to CACH and prove that they have failed to confirm their authorization on collecting your debt. It is your legal right to know about your account from the CA before sending money.

When you file your answer with the court,please ensure you put your counterclaims for fdcpa violations. They brought suit without validating.This is a fdcpa violation in itself.
