Debt Lawsuit

Has anyone been taken to court regarding a debt? I was wondering what happens and if it's best to do this or file for bankruptcy. I haven't worked for the past 3 years and take care of my disabled son. My husband's paycheck is already stretched to cover our living expenses. The lawsuit is against me.


Also , I found a letter from the above law office offering a payment plan back in november, should I try to respond to this or is it too late?

I called to get a mailing address to send a dv letter. They said it was too late because papers have been filed in court already. They of course asked about payment plans and how much I would be able to pay. They flat out rejected my offer and said they would resolve this in court. Can the court require me to pay more than I can afford?

My husband and I have been taken to court because of a debt. We had some medical bills that were turned over to a nasty collection agency and they took us to court and filed a judgement against us. It was like $900 or so. In order to avoid garnishment of our wages, I contacted the attorney's office that filed the judgment and made payment arrangements with them. I have been paying $50 a month for almost 2 years. I have 3 or 4 payments left. You can try doing that after it goes to court.We didn't go to court so they filed a default judgement against us.

ok, the supposed attorneys that sent me a settlement letter say it's too late to ask for a DV since they alreayd filed suit in March. I haven't received the notice of a lawsuit yet. do I have the right to get a DV now or do I have to wait to go to court (if I go that route)?
