Hi, I had credit card thru providian and best i can remember i havent made payment since 2003. I have credit report but doesent say anything about any payments. It is on here twice, once as placed under collection and then again saying purchased by another lender and both amounts are different but it is saying date opened is 2005 and one is saying 1999. I lived in va. when account was opened and now live in north carolina and lately i have been sent a paper stating that i have to go before a mediator, but before they sent this they sent me a letter and i wrote them back telling them i thought this was past the sol and that is when i get letter about mediator? Why should I even bother since it is already reported on my credit,,one as a charge off and the other showing in collection? And not sure how to tell when ai made last payment but it was years ago..any help please??


I understand NC and VA to have SOL's of 3 years on a credit card. If I am correct, then you would be within your rights to send a complete cease and desist letter. You can do this at any time, but it is not advisable if the SOL has not yet expired. Doing so will often trigger legal action to collect.

Sounds like they may have also attempted to re-age the debt. You might want to look for an attorney on naca.net.

Did you pay by check? If so, you should be able to obtain records/copies from your bank.

I'm sure others will chime in soon with more advice for you.
