Auto repo deficiency letter
Date: Fri, 04/13/2007 - 08:55
Is there anyone out there who can advise on when I send a repo deficiency letter.
History: auto repo last June: The day my car was hooked up OC wouldnt accept my offer to pay 2 more payments in 2 days but the thing that bothered me at the time was they sat on a check that I sent a week before the third month late would be due (the day car was repo), OC denied getting the check. Why didn't I fight it? At the time I was working my butt off, working 60+hrs a week as a nurse trying to keep my house and I was naive enough to think that since I didnt have the car, I didn't have to pay for it anymore. Well, I was wrong. The car was resold but I was never notified. I'm not denying payment but just only on what I owe. The CA that OC sold the account to sent me a 30 day notice and about a week later I get a "Notice of Intention" and I was an intended plaintiff. Don't they have to give me my 30 day to response before sending the NI. I the big question is can I send them the Why Chat Confusion deficiency letter now? * I verified resale through Carfax and was never notified. Please help, this has put a tremendous strain on me and my family.

You surely need some legal advice. He will help you in filing the papers. Laws on repossession vary from one state to another. You need to check with the Attorney General's office about the repossession rules. Which state are you in?
