Is there anyone out there who can advise on when I send a repo deficiency letter.
History: auto repo last June: The day my car was hooked up OC wouldnt accept my offer to pay 2 more payments in 2 days but the thing that bothered me at the time was they sat on a check that I sent a week before the third month late would be due (the day car was repo), OC denied getting the check. Why didn't I fight it? At the time I was working my butt off, working 60+hrs a week as a nurse trying to keep my house and I was naive enough to think that since I didnt have the car, I didn't have to pay for it anymore. Well, I was wrong. The car was resold but I was never notified. I'm not denying payment but just only on what I owe. The CA that OC sold the account to sent me a 30 day notice and about a week later I get a "Notice of Intention" and I was an intended plaintiff. Don't they have to give me my 30 day to response before sending the NI. I the big question is can I send them the Why Chat Confusion deficiency letter now? * I verified resale through Carfax and was never notified. Please help, this has put a tremendous strain on me and my family.
