I need some assistance! I received a summons from an attorney representing a creditor of mine on a bad debt from 10-2003. I live in California and I am very unclear as to what I need to do as a response letter or form. I have no idea where to obtain that form. Nor do I have 10k to repay this debt. Any pointers would be great. Thanks MJ


Make sure you show up for the court date!! If there isn't a date listed on the summons, call the court with the docket number and they'll give you the date. You'll have an opportunity to make payment arrangements at the hearing. Make sure you show up...If you don't they will get a default judgement against you, and your wages will be garnished.

Does the summons say that you have so many days to file an answer? if so, how many? this varies from state to state.

If you have a court date, show up or they will win by default, what type of debt is this?

I am being sued and am about 5 months into this crap, I can tell you the steps I have taken. I don't know if the steps I have taken has kept this out of court, but so far, so good. Bite my tongue! & Knock on wood!
