LTD Financial Services....can I sue them?

These people have been bugging me for about 5-6 months, probably 7 phone calls total. On Easter saturday they called once at 8:09 AM and once at 9:15 AM....fortunately for them I was in a tent in North Georgia or I would have flipped out on them. I do have those calls on my machine though.

They purchased some old debts...one from Tractor Supply and one from Citibank for my name...same name, wrong middle initial. They found my name in the phone book and decided I was their man and hoped they could get me to pay. I refused to give them my social, birthday, or anything else regarding my personal information and rightly so. Each time they called, I had some fun with them and told them the SSN they gave me is wrong, the birthday is wrong (one collector even agreed that I am not a 50 something year old sounding man), previous address is wrong, and even the name is wrong. I wouldn't tell them my middle initial either.

So after the Easter weekend calls, I called back twice and left Cheryl Funk two messages (the second, I told her I taped) that they have the wrong guy. I never had the account and that everything they have except for my phone number is incorrect. That was 4/7/2007. On 4/8/2007, I mailed a RR certified letter telling them to screw off (the collector CLAIMS they received it on the 13th, we will see). On 4/8/2007, they generated the letter stating I owe the debt and it was mailed on the 11th. The collector CLAIMS that they took everything out of the system as a result of getting my letter. Time will tell.

So having given them the proverbial finger, what should I do if they contact me more? I anticipate they will contact me more because for all they know, I could be the debtor they are after lying about being the debtor. How can I get money from these folks? What are the procedures for suing a collection agency?

I had a problem with them as well and have a pending suit against them. They called my home, my parents home, my neighbors, several strangers in my city with the same last name. During one of their mailings, they made the mistake of including a call list with the names and numbers of the above mentioned people. I sent them notice of what they sent, advised I was seeking legal action and I have not heard from them since. The case is pending as their legal staff has not responded to the complaint. I suggest contacting the FTC and the Attorney General in your state AND Texas. The Texas AG was awesome and very helpful. Good luck
