Midland Credit listed on the credit report

I was trying to clean up my credit report and saw a listing on two of the reports for Midland Credit Manangement. I disputed the report with the Credit Bureaus. One, removed it; the other I have not heard from yet.

Since the dispute, I now have a constable trying to serve me with, I assume; to be papers for legal action. This is on a debt that is 8 years old and the credit card company cancelled the card at that time. But my report shows that it is an open account.

At this point, what do you suggest? I live in Texas and don't know what the statute of limitations are. Any help would be appreciated.


The statute of limitations in Texas is 4 years. Try writing to the original creditor and see if you can get documentation that the account is either open or closed.

Make sure you find out whether they purchased the debt or are acting on behalf of the original creditor. they are legal to collect a debt in Texas.

atxmbb, thank you for your advice. But do I let the constable serve me or do I try to avoid him. I don't want to make things worse. What do you suggest?

Definitely accept service. That way you can file an answer including the SOL defense. If you duck service they will take a default against you. However, in Texas they cannot garnish your wages.

Always accept service. If you don't, they will get substituted service or service by publication, then you may not even know what they are asking the court to award, and they will take a default because you will not know when or where to answer.

Yall are great!...Thank you for all your advice. I will heed your advice and be served. And try to get as much info as I can from the orig creditor. Once served, will I have the opportunity to do the Validation request?
