Bank of America card sent to NCO for collections

So my fiance has a Bank of America card that has been send to NCO collection agency. He has been in contact with them back and forth trying to come up with some kinda of payment arrangement. He lives at home with his parents right now. NCO called his house yesterday and his little brother (11 years old) answered. They told him that if my fiance didn't make a payment today that they were coming to arrest him. I am outraged that they would tell a child this. He was unbelievable scared. Isn't this illegal or something. I told my fiance that he needed to report it to the Attorney General. What else should he do???


:!: That's illegal - he can sue them for major damages for doing that. First of all, they cannot state that they are going to arrest you, take you to court, sue you, anything, unless they are actually in the process of pressing suit against you. Secondly, they spoke to someone who wasn't authorized on the account about the account which is against privacy laws. I really suggest contacting a lawyer who represents the rights of consumers. There are a lot of people who are willing to take on these cases pro-bono because they'll get their money at settlement. I dealt with NCO years ago on a tiny account and had I known then about my consumer rights what I know now, I would've taken that company out of business. I almost lost my job because of the harrassing phone calls I was constinently receiving at work - they even zeroed out and got my boss and told him that I owed them money and wanted him to make my check out to them! :!: :!:
