question about a letter

I received a letter from a company (it says negotiating debt is their only business)saying a lawsuit has been filed against me and the sheriff will see me shortly. Is it possible they would know a suit has been filed against me before I would know? I'm pretty sure I read here in the forum that I can call the courts to check if a suit has been filed, is this correct? If this is correct and if the debt is correct, what's the difference of showing up or not if I can't at this time pay the debt off? I am working with a debt consolidation company and have sent this to them but wanted to ask here in the forum also as I value your expeirence and help.


I found about the wages for my state and it's a no-no for this type of thing. Can they get into my bank account somehow? I'm guessing from Suebee's response, they could know before I would know about a suit,yes/no/maybe? Also from forum, I should use money orders for any of these types of payments,correct? Thanks you guys, this forum rocks as the youngsters would say.

guest, you can't be garnished in your state for consumer debts, but you can have your accounts levvied, which can be worse than a straight garn, since there is no cap on how much they can take at once. I would definitely contact the creditor, as well as checking with the court, to see what arrangements can be made. No one wants to levvy your wages; this is extra time, money, and paperwork. It sounds like in this stage of the game you can still make arrangements. good luck.

I had a similar situation happen. I was notified by several attorneys offering to represent me in a lawsuit that I wasn't even aware was against me. You should be able to go to your county court house and find out who it is and contact them. In my case, original creditor and Midland Credit refused to speak to me and sent me straight to their lawyer. He was able to get Midland to settle outside of court. I had to pay them $600/ month for 3 months, but it was better than loosing my job for wage garnishment. Make sure you follow up though that the lawyer lets the courts know if it does get paid off outside of court. I just checked my record last week and found out the courts issued a default judgement on me even though I paid Midland off in February because the lawyer representing Midland did not notify the courts that we settled outside of court.
