Allied Interstate on behalf of LVNV
Date: Fri, 04/20/2007 - 17:08
I received a letter from a company called allied interstate that said LVNV Funding had purchased a delinquent Sears acct of mine and payment was due immediately to Allied. I settled and paid in full with Allied in March 2007. Initially, LVNV had the Sears acct listed as a charge off in Feb '07. Since making the payment in March, LVNV has now listed the account as a collection with a totally different balance. Being that I paid Allied, who collects for LVNV, shouldn't LVNV take the collection down and show the debt satisfied? I have a letter from Allied showing the account paid in full and the balance at $0. I feel as though I paid a settlement to Allied but LVNV is now showing the difference of my original balance. Is that legal?

I would also add, if this is the first letter, if they used the words "due immediately", you might be able to sue them under the fdcpa, because they provided no proof that you indeed are liable for a debt they hold.

Cajun is right. Also, a word to the wise -- save the envelopes these letters come in. I believe the fdcpa says that no other words od "literature" can be on the envelopes except for the addresses. As you know, some have "open immediately", "time dated material", and numerous other things written on them.
