Letters from Attorneys concerning a Cause filed against me

Over the last few weeks I have received several letters from Houston attorneys offering their assistance because:

Quote from letter - [From information published by the Harris County Clerk, I know that Craig A. Noack filed a case against you....]

The referenced official information states:

Quote from letter - [Cause No. xxxxxx; Asset Accept LLC v. (my name); Harris County.....

My questions:

1. What exactly is a 'cause'. I have been trying to find information on my cause number from the Harris County web site but no info is available.

2. Again, I've talked to one of the attys and he suggest that i do nothing until served with legal documents. Is that the right thing for me to do?

3. I've found a 'Craig Noack' listed as the operator of asset acceptance llc in San Antonio. Can he file for a cause without atty representation?

4. I feel like I need to be doing something as I am getting hit from several directions about past debt. What should I be doing?


I had the same thing happen to me. I started getting letters from various attorneys offering to represent me in a case that I wasn't even aware of. After I called the courts, I found out they had been trying to "serve" my old address which is why I never found out I was even being sued. Best of luck!

1) cause, as in cause of action in which the plantiff is seeking a judgment against you in order to recover money.
2) the attorney is right, but, as someone said, call the county clerk and ask if someone has filed suit against you.
3) He might not be personally filing suit, but his attorneys can.
4)the most important thing for the moment is to find out if you really are being sued. If you find that you are not, sue Asset Acceptance.

In Texas, the cause number is the identification the court uses for the particular case. It is not uncommon for a CA to file suit and continue to try to collect before having you served.

Anyone can file a lawsuit without attorney representation. Most commonly it is done in small claims/justice courts.

It is a good idea to go to the court and get a copy of the petition so you can see who is suing you, how much they are seeking, and where they claim you live. This is important because some CA's have been caught trying to serve people at former addresses even though they have a current one. That allows them to get an easy default judgment. Good luck.

the same attorney i listed on paperwork from the court saying asset acceptance is suing for and account that went into chargeoff in 2003. i am now having to fight this because i am in the process of buying a house.i get different dates of the charge off from the company,the credit reports and the paperwork filed. paperwork shows delinquent as of 2003 but asset says payment was made to citibank in 2004. asset is trying to say they barely bought the account in 2006 and has been with citibank for all these years in collections. if payment was last made in 2004 then wouldn't that put my delinquency as of then and not 2003?
