A response from my state DFI

We have received a letter from the debt collection agency in response to your complaint involving its collection of a payday loan you made online with PayCheckToday.com. The letter is dated April 23, 2007, and states that the collection notice sent to you showed an incorrect balance due of $810, that they have now corrected the balance due. While the letter does not specifically state this and I cannot be certain, I gather from the last statement regarding the e-mail of January 17 that the settlement offer may still be on the table. The payment history the company provided compares with, and is apparently accurate, with the exception of one $90 payment PayCheckToday drafted from your account on November 24 but is not reflected on the payment history from the debt collector. The letter also states that you authorized an "extension" payment of $90 for December 8, which was returned NSF, and that the lender called you about that (no date) and you then authorized a $90 extension fee payment and a $30 NSF fee payment for December 15, 2006. That payment was returned NSF. It states that the lender called you numerous times after that (no dates given), and that you set up a payment in full (no amount given) to be drafted from your account on January 5, 2007, but that payment was also returned NSF. The bank statement you provided shows the amount of that debit was $300. Please let me know how you would like to proceed. |
Now how stupid would I be to agree on payment arrangements to be taken out of a closed checking account? Plus I never got a settlement offer from them. What would you all do? I have paid them $270 in interest and have $319 in NSF fees from my bank just for this payday loan. I am thinking about offering $120. That would be the loan + 1 interest payment then subtract what I already paid to them. Do you think that is a fair settlement offer? Considering they do not have a license to lend in my state.

So at first they started out with a total of $810 Then when the DFI contacted them it went down to $390 now they are accepting $120. How cool is that :D

Congratulations! I am surprised that they even answered the DFI. UCL won't answer the AG's complaint that I filed. I am very happy that they are settling for the $120 for you!

Yep Steelers I already did that. I also printed a copy for myself for my own file lol. I even said the same thing to the DFI about how it went from 810 to 390 then because I told them if they did not respond I would contact the bbb and tell the dfi to take any kind of measures she can about getting me my nsf charges back. lol
Thanks Sassnlucy, I was suprised also. But she had to mail them a couple of times. Bass still hasn't replied to her neither has platinum b services or united pay services lol but at least they are not calling anymore so I am going to leave those alone.
