Well, that is why they have that recording at the beginning of the phone call, it's a little trick that you've been informed, even though you weren't verbally asked. That is why, you should tell them (if you hear that message), you do NOT want to be recorded, that way it won't be admissible in court. Also repeat it throughout the conversation so they can't try to cut it out.

Actually, by not hanging up you're giving your consent to be recorded, depending on how good your lawyer is :) I think they call it implied consent.
