In Massachusetts and other states, it is illegal to record someone unless you have their permission. What I am wondering is if when you first call a debt collector and there is a recorded message saying " this call may be recorded" Do they still have to ask your permission to record you?


Well, that is why they have that recording at the beginning of the phone call, it's a little trick that you've been informed, even though you weren't verbally asked. That is why, you should tell them (if you hear that message), you do NOT want to be recorded, that way it won't be admissible in court. Also repeat it throughout the conversation so they can't try to cut it out.
